Water Eleuthera Tours (“W.E.T.”) – Participant Waiver, Release of Liability, and Assumption of Risk

I wish to participate in water-based activities (including but not limited to boating, jet skiing, kayaking, paddleboarding, snorkeling, and sandbar tours) operated or arranged by Water Eleuthera Tours and its owners, employees, agents, and contractors (collectively “W.E.T.”). I understand that these activities take place in open water, near boats and equipment, and involve inherent risks including but not limited to: drowning, collision, injury from equipment or marine life, changing weather and sea conditions, and other risks that cannot be fully eliminated.

I voluntarily assume all such risks. I represent that I am in good physical condition and able to participate, and that I can swim or will wear approved flotation as directed. I will follow all safety instructions given by W.E.T. staff.

In consideration of being allowed to participate, I hereby release, waive, discharge, and covenant not to sue Water Eleuthera Tours, its owners, employees, agents, contractors, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever (including negligence) arising out of or related to my participation, including injury, death, or property damage, whether caused by the negligence of W.E.T. or otherwise.

I agree that this waiver is binding on me, my heirs, assigns, and personal representatives. I have read this waiver in full, understand it, and sign it voluntarily. If I am signing on behalf of a minor, I represent that I am the parent or legal guardian and agree to the same terms for the minor.
